Struck Love Case Among 2018 Top Ten Civil Defense Verdicts

Arizona Attorney magazine’s June issue features the Top Ten Civil Defense Verdicts of 2018.  Receiving recognition was Ferriera v. Maricopa County et.al., a trial in the U.S. District Court for the District of Arizona.  The plaintiff brought state and federal claims alleging Maricopa County Sheriff Paul Penzone and Dr. Jeffrey Alvarez were responsible for the death of her son (Daughtry) after he was killed by another inmate while incarcerated at Maricopa County’s Fourth Avenue Jail.  She alleged that Daughtry should have been housed in the Mental Health Unit and that the Defendants failed to protect him by housing him in general population.  She requested $15 million in damages.  Dan Struck and Ashlee Hesman defended the case at trial.  The Defendants presented evidence that Daughtry was appropriately classified and housed, and that his assault was not foreseeable. The jury returned a complete defense verdict.
